By accessing or using the W1.nz hosting service in any way — including browsing this website, requesting a subdomain, or uploading content — you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the service.

1. About the Service

W1.nz is a free static web hosting service operated by BestAI (referred to as "we", "us", or "our"). We provide users ("you") with a subdomain (e.g., yourname.w1.nz) and server space to host static website files (HTML, CSS, JavaScript, and images).

This service is provided entirely free of charge. No payment is required, and no payment will be requested.

2. Acceptance of Terms

By using this service, you agree to these Terms of Service in their entirety. Your use of the service constitutes ongoing acceptance of these terms. We may update these terms at any time by posting the revised version on this page. Continued use of the service after any changes constitutes acceptance of the updated terms.

3. Service Description and Limitations

Static hosting only. We host static files (HTML, CSS, JavaScript, images, fonts, SVGs). No server-side scripting (PHP, Python, Node.js, etc.) is supported.
Storage limit. Each user account is allocated a maximum of 10 GB of storage.
No video hosting. Video files may not be stored on the service. You may embed videos from third-party platforms (e.g., YouTube).
Subdomain only. We provide subdomains under w1.nz. Custom domain support is not included.

4. Disclaimer of Warranties and Limitation of Liability

This is a free community service. By using it, you accept that the service is provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied.

4.1 No Warranty

We do not warrant or guarantee:

That the service will be uninterrupted, timely, secure, or error-free
That any data or content hosted on the service will be preserved, backed up, or recoverable
That the service will meet your specific requirements
The accuracy, reliability, or completeness of any information provided through the service
That the service will be available at any particular time or for any particular duration

4.2 No Data Backup

We do not provide any data backup, data recovery, or data archival services. We do not maintain copies of your website files. If your data is lost, corrupted, or deleted for any reason — including but not limited to hardware failure, software error, security incident, or service discontinuation — it is permanently lost. You are solely responsible for maintaining your own local backups of all content you upload to the service.

4.3 Limitation of Liability

To the maximum extent permitted by New Zealand law:

We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.
We shall not be liable for any loss of data, loss of revenue, loss of business, or any other losses resulting from data loss, service interruption, or service discontinuation.
Our total aggregate liability to you for any claims arising from the service shall not exceed NZ$100.
As this is a free service provided at no cost to you, you acknowledge that the disclaimers and limitations in this section are reasonable and proportionate.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under New Zealand law, including liability under the Consumer Guarantees Act 1993 to the extent it applies.

4.4 Indemnification

You agree to indemnify and hold harmless BestAI, its owners, employees, and agents from and against any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the service
Content you publish on the service
Your violation of these terms
Your violation of any applicable law or regulation

5. Your Content and Data

5.1 Ownership

You retain full ownership of all content you upload to the service. By uploading content, you grant us a limited, non-exclusive licence solely to host and serve your files as part of the service. We claim no other rights to your content.

5.2 We Do Not Access Your Data

We do not read, analyse, modify, sell, or otherwise use the content you upload. Your website files are yours alone. We access your hosting space only when necessary for technical maintenance of the server infrastructure.

5.3 Your Responsibility

You are solely responsible for:

The legality and appropriateness of all content you publish
Maintaining local backups of all your files
Ensuring your content does not infringe on any third party's intellectual property rights
Complying with all applicable New Zealand laws and regulations

6. Acceptable Use Policy

You agree not to use the service to host, publish, or distribute:

Content that is illegal under New Zealand law
Malware, phishing pages, or any form of malicious code
Content that infringes copyright or other intellectual property rights, including any violation of the Copyright Act 1994
Pornographic, obscene, or sexually explicit material
Politically sensitive or extremist content
Content that promotes violence, hatred, or discrimination
Spam, bulk advertising, or unsolicited commercial content
Content designed to harass, threaten, or harm individuals
Video files (in accordance with our fair usage policy)

6.1 Prohibited Site Types

The following types of websites are strictly prohibited and will be shut down immediately and unconditionally upon discovery:

Image hosting sites — sites used primarily as image repositories or image-hosting services for third-party platforms
Download sites — sites used to distribute file downloads, software, or other bulk content
Video sites — sites hosting or streaming video content
Copyright-infringing sites — any site that hosts, distributes, or links to pirated or unlicensed content
Pornographic or adult content sites
Politically sensitive or extremist sites

6.2 Fair Usage and Abuse Prevention

This service is intended for individuals and small-to-medium businesses to host legitimate websites. Your usage must comply with the principle of fair use:

You may not use your hosting space as an image hosting service (image bed), file download server, or any form of bulk storage service for third-party access.
You may not use the service in any way that disproportionately consumes server resources, bandwidth, or storage to the detriment of other users.
Abusive or disproportionate use of the free hosting space — including but not limited to using it as a CDN, proxy, file mirror, or storage backend for external applications — constitutes a violation of these terms.

We monitor aggregate resource usage (not your content) to ensure fair access for all users. Accounts found to be in violation will be suspended or terminated without prior notice.

6.3 Enforcement

We reserve the right to immediately and unconditionally shut down any site that violates the Acceptable Use Policy, including but not limited to prohibited site types and fair usage violations. No refund, compensation, or data recovery obligation applies, as this is a free service.

7. Harmful Digital Communications

In accordance with the Harmful Digital Communications Act 2015 (New Zealand), we maintain a complaint handling process for content hosted on our platform.

To report harmful content: Email [email protected] with the subject line "Content Complaint" and include the URL and description of the concern.
We will process complaints in accordance with the safe harbour provisions of the Act.
Content authors will be notified and given the opportunity to respond.
Content may be removed if the author does not respond within 48 hours or agrees to removal.

8. Service Availability and Termination

We aim to keep the service available but do not guarantee uptime or availability.
We may suspend or discontinue the service at any time, for any reason, with or without notice.
We will make reasonable efforts to provide 30 days' notice before any planned discontinuation of the service.
You may stop using the service at any time. To request removal of your subdomain and data, contact us at [email protected].

9. Governing Law

These terms are governed by the laws of New Zealand. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
